So here’s a summary of each Queensland Council’s position on accommodation that is not considered a small second home.

Temporary homes may be occupied on vacant land by the owner of the land for less than 2 weeks in any 52-week period.

Or if there is an existing dwelling for less than 4 weeks in any 52-week period, so long as:

(i) the temporary home is located to the rear of the existing dwelling house; and

(ii) no waste materials, including grey water, are deposited on site during occupation, or left on site after departure.

For up to 28 days in any calendar year, a person ordinarily resides elsewhere can occupy a temporary home on private land if sanitation facilities are provided and maintained to a satisfactory standard.

No approval is needed for the establishment or occupation of a temporary home for less than six
consecutive months to complete essential repairs or renovations to an existing home.

If camping, a person MUST not camp within 3 km of a township or caravan park; otherwise, a permit is required.

When obtaining a permit to camp within 3 km of a township or caravan park, the Council MAY impose the permit condition “habitation must not exceed 14 days”.

Fraser Coast will allow the occupation of a caravan for up to 6 months of a calendar year if conditions are met. The list is extensive (please click the link below to have it delivered to your inbox).

Whereas temporary homes that are not a class 10a building or structure may be occupied for less than:

  • 2 weeks in any 52-week period on a vacant property; or
  • 4 weeks in any 52-week period on land with a dwelling.

Caravan or tiny house on wheels

Either a building approval or a camping area licence is needed for living in a caravan or tiny house on wheels on your property.

Tiny houses need a building and plumbing approval just like a normal house.

When they include their own bathroom, laundry and kitchen there are also planning issues to check such as a secondary dwelling or dual occupancy use.

Tiny houses don’t include registered vehicles or vehicles that can be registered. These vehicles are administered under our local law, which also restricts their use as accommodation.

Caravans no longer registered and moveable are classed as a permanent structure and will require relevant approvals by law and City Plan.
